Warranties + Terms & Conditions
This document outlines the terms and conditions for our gutter and gutter filter installation services, including 18-month workmanship warranties for both the gutters and filters, covering leaks and clogs, as well as a 20-year or lifetime product/material warranty. It also details customer responsibilities, limitations, exclusions (such as damage from acts of God, ice damming, or external factors), and provides guidance for warranty claims and inquiries.

1. Agreement Overview
These Terms and Conditions ("Agreement") govern the relationship between [P.R Lake Michigan Seamless Gutters] and the customer for the provision of gutter installation and related services, including gutter filters. By accepting Our Services, You agree to be bound by these terms.
In the event that our installers identify rotted fascia board during installation, they will stop work and notify the homeowner immediately. The installer will recommend replacing the fascia board, and if the homeowner decides against it, the lead installer will document the condition with photos uploaded to Our Google Drive. Additionally, the homeowner will be required to sign a new contract, either physically, verbally, or via text/call, acknowledging that the Company will not be liable if the gutter system fails due to the lack of proper support.
2. Scope of Services
The Company will provide gutter installation services, including the installation of gutters, downspouts, and optional gutter filters as requested by the Customer. The Company will perform all work in a professional and timely manner, adhering to industry standards and safety protocols.
3. Warranty Coverage
Workmanship Warranty:

Gutters: The Company guarantees that all gutter installation work will be free from defects in workmanship for a period of 18 months ("Workmanship Warranty"). This includes a guarantee against any leaks within the installed gutters. Should any leakage occur within the 18-month period, the Company will repair or replace the affected sections at no additional charge to the Customer.

Filters: The Company also guarantees that all gutter filter installations will be free from defects in workmanship for 18 months ("Workmanship Warranty"). This warranty covers any clogs caused by the filter installation process. Should any clog occur within the 18-month period, the Company will address and resolve the issue at no cost to the Customer.
Product/Material Warranty:

Gutters and Filters: Both the gutter system and the filters are covered by a 20-year or lifetime warranty, depending on the manufacturer’s specifications, against defects in materials or products used. Should any issues arise due to faulty materials or products, the Company will arrange for repairs or replacement of the gutter system or filter at no cost to the Customer. Please note that this warranty does not cover damage caused by external factors such as weather conditions, physical impact, or improper maintenance by the Customer.
4. Limitations and Exclusions
The Workmanship Warranty and Product/Material Warranty do not cover:

Acts of God and Natural Disasters: Damage caused by natural disasters, such as severe weather events, hurricanes, tornadoes, floods, or any acts of God (including but not limited to trees, vehicles, high winds, ice, snow, or hail) is not covered under this warranty.

External Damages: Damage to the gutter system or filters caused by accidents, neglect, misuse, or third-party actions is not covered.

Improper Maintenance or Modifications: Damage resulting from improper maintenance by the Customer, alterations, or modifications made by the Customer or any third party not authorized by the Company.

Ice Damming and Related Damage: The Company is not liable for any damage caused by ice damming or similar issues unless the Customer has notified the Company in advance of potential ice damming concerns. If such issues arise and the Customer has not made the Company aware, the Company will not be held liable for any resulting damage.
5. Customer Responsibilities
The Customer agrees to:

Annual Cleaning: Annual gutter cleaning is required to maintain the system and prevent ice damming, debris buildup, or clogging. Failure to adhere to this requirement may void warranties related to the system's performance.

Ice Dam Prevention: To help prevent ice damming, the Company may recommend the installation of heat wires. If ice damming concerns exist, these will be discussed and addressed as part of the installation process.

Notification of Ice Damming Risks: The Customer must inform the Company of any known or suspected risk of ice damming, such as areas with a history of winter weather issues. Failure to disclose such risks may result in the Company not being liable for any resulting damage to the property or the gutter system.
6. Service Fees
The Customer agrees to pay all fees associated with the installation and services provided. All payments are due upon completion of the work unless otherwise agreed upon in writing. If any warranty service is required, it will be provided at no additional cost during the applicable warranty periods.
7. Dispute Resolution
In the event of a dispute, both parties agree to resolve the matter through mediation before resorting to legal action. If mediation is unsuccessful, the dispute may be taken to court.
8. Governing Law
This Agreement shall be governed by the laws of [MICHIGAN], without regard to its conflict of law principles.
9. Termination of Agreement
Either party may terminate this Agreement by providing written notice to the other party. Any outstanding fees for services rendered will remain due and payable.
10. Modification of Terms
The Company reserves the right to modify or amend these Terms and Conditions at any time. Any changes will be communicated to the Customer and will be effective immediately upon notification.
